IGNITE DEVELOPMENT
RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK & INDEMNITY AGREEMENT
IMPORTANT – PLEASE READ CAREFULLY
This Agreement is a legally binding document. By checking the acknowledgement box at the end of this Agreement and submitting your registration, you acknowledge that you have read, understood, and agreed to all of its terms. By doing so, you may be waiving certain legal rights, including the right to make certain legal claims against Ignite Development, except where such rights cannot legally be waived under applicable law.
If the Participant is under eighteen (18) years of age, this Agreement must be accepted by the Participant's parent or legal guardian.
1. Participation
In consideration of Ignite Development permitting the Participant to attend and participate in basketball camps, clinics, private training, group training, academies, leagues, tournaments, practices, games, strength and conditioning sessions, educational programs, and any other activities, services, or events organized, operated, or sponsored by Ignite Development (collectively, the "Activities"), I agree to the terms of this Agreement.
2. Representation of Physical Fitness
I represent and warrant that the Participant is physically fit and medically capable of safely participating in the Activities. I further certify that all known medical conditions, allergies, injuries, medications, disabilities, physical limitations, or other health concerns that could affect participation have been accurately disclosed during registration.
I understand that participation should immediately cease if the Participant experiences pain, dizziness, illness, injury, or any condition that could make continued participation unsafe, and that an Ignite Development coach or staff member should be notified without delay.
3. Assumption of Risk
I acknowledge and understand that participation in basketball and athletic training involves inherent and unavoidable risks. These risks include, but are not limited to, slips, trips, falls, collisions with other participants, contact with basketballs, equipment, walls, floors, hoops, or other objects, sprains, strains, muscle or ligament injuries, fractures, cuts, bruises, dental injuries, eye injuries, concussions, other head injuries, dehydration, heat-related illness, cardiac events, permanent disability, paralysis, and death.
I understand that these risks may arise from my own actions, the actions of other participants, the condition of facilities, equipment failure, or the acts or omissions of Ignite Development or others. I voluntarily choose to participate, or permit my child to participate, in the Activities and knowingly assume all risks associated with participation, whether known or unknown, foreseeable or unforeseeable.
4. Release of Liability
To the fullest extent permitted by the laws of the Province of Alberta and the applicable laws of Canada, I release, waive, discharge, and forever hold harmless Ignite Development and its owners, directors, officers, coaches, instructors, trainers, employees, volunteers, contractors, representatives, sponsors, facility partners, successors, and assigns (collectively, the "Released Parties") from any and all liability, claims, demands, actions, damages, losses, expenses, costs, or legal proceedings arising directly or indirectly from participation in the Activities.
This Release applies to claims arising from personal injury, illness, property damage, economic loss, disability, or death, including claims arising from the negligence of the Released Parties, except where liability cannot legally be excluded under applicable law.
5. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, demands, actions, liabilities, damages, costs, expenses, or legal fees arising from the Participant's participation in the Activities, any breach of this Agreement, or any claim brought by or on behalf of the Participant relating to participation in the Activities.
6. Emergency Medical Authorization
In the event of an accident, illness, injury, or medical emergency, I authorize Ignite Development to contact emergency medical services, arrange emergency transportation, contact the emergency contact provided during registration, and obtain emergency medical treatment that is reasonably necessary until a parent, guardian, or emergency contact can be reached.
I understand and agree that all medical expenses incurred are my sole responsibility.
7. Medical Disclosure
I certify that all medical information provided during registration is complete and accurate. I understand that failure to disclose relevant medical information may increase the risk of injury and may limit Ignite Development's ability to respond appropriately in the event of a medical emergency.
8. Concussion Acknowledgement
I understand that basketball is a sport in which concussions and other head injuries may occur. If a concussion or head injury is suspected, I understand that the Participant may be removed from participation immediately and may not be permitted to return until appropriate medical clearance has been obtained where required.
9. Participant Conduct
I understand that Ignite Development is committed to providing a safe, respectful, inclusive, and positive environment for all participants. Participants are expected to behave respectfully toward coaches, staff, officials, teammates, opponents, spectators, and facilities, to follow all coaching instructions and safety rules, and to conduct themselves in an appropriate manner at all times.
Ignite Development reserves the right to suspend or remove any participant whose behaviour is unsafe, disruptive, abusive, threatening, discriminatory, or otherwise inappropriate. Such removal may occur without refund.
10. Personal Property
I acknowledge that Ignite Development is not responsible for any lost, stolen, or damaged personal property brought to or used during the Activities. Participants remain solely responsible for their personal belongings.
11. Privacy
I consent to the collection, use, storage, and disclosure of the personal information provided during registration for the purposes of administering Ignite Development programs, communicating regarding participation, and responding to emergencies. Personal information will be handled in accordance with Alberta's Personal Information Protection Act (PIPA).
12. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the applicable federal laws of Canada.
13. Severability
If any provision of this Agreement is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
This Agreement constitutes the entire agreement between the parties relating to participation in the Activities and supersedes any prior discussions, representations, or agreements relating to its subject matter. No amendment or modification shall be binding unless made in writing by Ignite Development.
ELECTRONIC ACKNOWLEDGEMENT AND ACCEPTANCE
By checking the box below and submitting my registration, I acknowledge that I have carefully read and fully understand this Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement. I understand the nature of the Activities and the risks associated with participation. I voluntarily agree to all of the terms and conditions contained in this Agreement and understand that I may be giving up certain legal rights, including the right to make certain legal claims against Ignite Development, except where such rights cannot legally be waived.
I certify that the information provided during registration is complete and accurate. If the Participant is under eighteen (18) years of age, I certify that I am the Participant's parent or legal guardian and have the legal authority to accept this Agreement on the Participant's behalf.
I understand and agree that checking the box below and submitting my registration constitutes my electronic signature and has the same legal force and effect as my handwritten signature.
